Employer can—and should—investigate off-duty dispute between employees | HR Hero Line

This is a very tricky area, and both lawyers and courts have come down on each side of the issue. Court cases stating the Company did not have the responsibility nor even in some cases the right to investigate off premise employee behavior to include possible violence. But in some cases it has been a factor of monetary liability if the Company did not take what are called reasonable inquiries into the safety of an employee involved in what could turn into work place violence. A company policy on the subject is not recommended and all actions should be on a case by case basis. But it is another area we in the Security Profession need to be aware of.
